A certificate of Sponsorship is assigned to each foreign worker that is employed by a company with a sponsorship licence. This is an electronic record and each certificate has its own number which a worker can use to apply for a visa.
There is a type of certificate, known as the Restricted Certificates, that are limited in how many are issued each month.
These are for:
• Tier 2 (General) workers currently abroad who’ll be paid less than £159,600 a year and are not in an inward investment post
• family members (dependants) of Tier 4 migrants who are switching to a Tier 2 visa
For these workers, a restricted certificate needs to by applied for through the sponsorship management system (SMS). Only employers with a sponsorship licence will have access to this. The applications for this must be submitted by the 5th of the month and a panel meets to decide which applications to approve. Only once an application is approved can the employer assign the Cos to the individual that they are looking to employ. The individual can then make an application for entry clearance to work in the UK.
These applications are assessed using a points system. As there is a set quota of how many can be issued each year, applications for the certificate must have a set number of points as part of the assessment process. This system of monthly quotas has existed since 2011. However, December 2017 was the first that the set limit was exceeded in any one month and since this time, the number of applications for the Restricted Certificate of Sponsorship has been constantly in excess of the quota.
In response to the high number of applications, UK Visas and Immigration removed doctors and nurses from the quota of the Restricted CoS in June 2018. This has allowed more certificates to become available others to applying for the same certificate. This change seems to have brought about a positive change to the quota. This includes that the
The August allocation meeting took place on 13 August. All valid applications received by 5 August were successful if they scored at least 21 points.
